If you are the immediate relative (spouse, children, and parents) of a U.S. citizen and / or lawful permanent resident, you can apply for provisional unlawful presence waivers before leaving the United States for your consular interview as a beneficiary of a Family Petition.
The provisional unlawful presence waiver process allows those persons who are legally eligible for an immigrant visa (immediate relatives, family-sponsored or employment-based immigrants, as well as persons selected by the Diversity Visa); that they only need a waiver of inadmissibility for unlawful presence to apply for that waiver in the United States before leaving for their immigrant visa interview.
